Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to use of this Website, these Terms, or the content displayed on the Website shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Hamilton County, Indiana, before a single neutral arbitrator, and judgment on the award may be entered in any court of competent jurisdiction.

Each party shall bear its own attorneys’ fees and costs unless otherwise required by applicable law. This agreement to arbitrate includes all statutory and common law claims and is intended to be interpreted broadly. Small claims that fall within the jurisdictional limits of the Indiana small claims courts may, at either party’s option, be brought there instead of arbitration.

You and the Company agree that any arbitration shall be conducted solely in an individual capacity and not as part of any purported class, collective, or representative proceeding. You waive the right to a jury trial to the fullest extent permitted by law.

Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Indiana, except as otherwise provided in the arbitration section above.

Changes to These Terms

We may update these Terms from time to time to reflect operational or legal changes. The “Last updated” date above indicates the most recent revision. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
